How to Inherit a House in Ukraine

Inheriting a house is one of the most common notarial and legal procedures in Ukraine. After the death of a property owner, the heirs must apply to a notary within the statutory period, submit the required documents, and complete the inheritance procedure. In practice, however, inheriting a house is often complicated by missing documents, errors in title documents, issues involving the land plot, or disputes between heirs.

Documents Required to Inherit a House

The process begins with preparing the documents required to open an inheritance case. To initiate the inheritance procedure, the heir must submit a basic set of documents to the notary. The standard list generally includes:

1. the heir’s passport and tax identification number;
2. the deceased owner’s death certificate;
3. documents confirming the family relationship with the deceased, such as a birth certificate, marriage certificate, or extracts from the civil status registers;
4. the will, if the house is inherited under a will;
5. certificates or other documents confirming the deceased’s last place of residence;
6. title documents for the house;
7. the technical passport for the house;
8. documents relating to the land plot, where both the house and the land are inherited.

These documents enable the notary to identify the heir, confirm the heir’s legal entitlement to inherit, and verify that the house belonged to the deceased.

Title Documents for the House

Some of the most important documents are those confirming the deceased owner’s title to the property. These may include a sale and purchase agreement, a gift agreement, a certificate of ownership, a previous Certificate of Inheritance, or another document establishing ownership of the house.

Inheritance of a House by Law or Under a Will

A residential house may be inherited in two principal ways.

The second is inheritance under a will. If the deceased left a valid will, the persons named in the will are entitled to inherit the house. At the same time, Ukrainian law protects certain individuals who may be entitled to a mandatory share of the estate regardless of the contents of the will.

Upon completion of the inheritance procedure, the heir receives a Certificate of Inheritance, which serves as the legal basis for state registration of ownership of the house.

Disputes frequently arise regarding the composition of the estate, the validity of a will, the determination of the heirs’ shares, or the expiry of the inheritance acceptance period.
