Inheritance After the Death of a Relative in Ukraine

How the Inheritance Procedure Works in Ukraine

There are two legal grounds for inheritance: inheritance under a will, where the deceased left a valid will, or intestate succession, where the estate is distributed according to the order of heirs established by the Civil Code of Ukraine. The first priority of heirs includes the deceased's children, surviving spouse, and parents. If there are no heirs in the first priority, or they decline the inheritance, the right passes to the second priority of heirs, then the third, and so forth.

The documents required to accept an inheritance depend on the particular circumstances of each case, but they generally include the deceased's death certificate, documents confirming the family relationship (such as birth or marriage certificates), title documents for the inherited property, and the heir's identification documents. Where the deceased left a will, the original will must also be submitted. In practice, additional documents are often required. For example, it may be necessary to establish family relationships through court proceedings, locate missing property records, or confirm the composition of the estate.

Inheritance Acceptance Deadline

Perhaps the most important practical rule every heir should know is that the inheritance acceptance period in Ukraine is six months from the date of the deceased's death. During this period, the heir must file an application with the notary accepting the inheritance.

A missed inheritance deadline is one of the most common reasons why clients seek our assistance. Many people learn about the inheritance too late, live abroad, have lost contact with relatives, or simply do not realize that the six-month period has already expired. When the deadline has been missed, there are generally two possible solutions: obtaining the written consent of the heirs who have already accepted the inheritance to include the additional heir, or applying to the court to restore the inheritance acceptance period.

The restoration of the inheritance acceptance period through court proceedings is possible where the deadline was missed for legally valid reasons. Each case is assessed individually. Long-term illness, living abroad, lack of knowledge of the deceased's death, or being unaware of the existence of inherited property may all constitute valid grounds for restoring the deadline. This certificate serves as the legal document confirming the heir's ownership rights to the inherited property.
