The court considers whether there were valid reasons for the delay, such as serious illness, residence abroad, or lack of knowledge of the deceased's death.
- Intestate succession. Where the deceased left no valid will, the estate is distributed according to the statutory order of succession. Disputes frequently arise between heirs of different priority levels, including claims for exclusion from succession or changes to the statutory order of inheritance.
- Will contests. If there are legitimate doubts about the validity of a will, such as allegations of forgery, undue influence, or the testator's lack of legal capacity, the will may be challenged before the court.
- Establishing family relationships. Some heirs do not possess documents proving their relationship to the deceased. In such cases, the court may establish the legal fact of the family relationship, allowing the inheritance process to continue.
- Inheritance disputes between heirs. Disagreements regarding inheritance shares, the division of property, or the exclusion of an unworthy heir may only be resolved through court proceedings.
- Recognition of ownership through inheritance. Court proceedings are often required where ownership of a specific inherited asset must be formally recognized.
Court proceedings may also be necessary when inheriting an apartment, residential house, or land, particularly where the notary refuses to issue a Certificate of Inheritance because required documents are missing or legal issues remain unresolved.
