Inheritance Legal Services in Kharkiv

Inheritance matters have their own particular complexities, including significant amounts of property that were never formally registered, information in technical passports and state land ownership certificates that does not correspond with modern registers, and archival documents held by institutions throughout the country. For this reason, even a seemingly straightforward inheritance procedure may require professional legal support.

We provide a full range of inheritance law services, from standard notarial administration to court representation and the protection of heirs’ rights. Each of these services is described in more detail below.

Inheritance Administration

Standard inheritance administration includes identifying the assets that form part of the estate, reviewing title documents, preparing the complete set of documents for the notary, monitoring statutory deadlines, and obtaining the Certificate of Inheritance. In practice, most delays arise during the document collection stage because of errors in official registers, inconsistencies in names and surnames, or missing technical documentation. We identify these issues in advance and resolve them before the documents are submitted to the notary.

Inheritance Through Court Proceedings

Inheritance through court proceedings in Kharkiv may be necessary where the notary has no legal grounds to issue a Certificate of Inheritance. This may occur where the deceased’s ownership rights were not registered in the official register, the documents contain inconsistencies, or the property was acquired under agreements that were not notarized as required. Establishing inheritance rights through court proceedings is a separate legal process that requires a properly drafted statement of claim and a sufficient evidentiary basis. We prepare the case from beginning to end and represent the client at every level of court.

The six-month inheritance acceptance period may be missed for various reasons, including illness, residence abroad, or lack of knowledge that the inheritance had been opened. The restoration of the inheritance acceptance period in Kharkiv requires court proceedings and is possible only where the delay resulted from valid reasons supported by evidence. We analyze the circumstances, assess whether the evidence is sufficient, and prepare the claim. Where there are no proper legal grounds for restoring the deadline, we explain this immediately so that the client may consider other available ways to protect their inheritance rights.

Inheritance Disputes

Inheritance disputes commonly arise in several situations, including the division of property between multiple heirs, recognition that a person effectively accepted the inheritance, removal of an heir from succession, and protection of the right to a mandatory share. Each category has its own procedural requirements. We develop the legal position, collect the necessary evidence, and conduct the case before the courts. Where an out-of-court settlement is realistically available, we recommend it as the preferred option.

A will may be challenged in Kharkiv on the grounds provided by law, including the testator’s legal incapacity or limited legal capacity, execution of the will under coercion or as a result of deception, or failure to comply with the required form. A claim seeking to have a will declared invalid involves a high evidentiary threshold. Before filing proceedings, we therefore conduct a detailed assessment of whether genuine legal grounds exist, which evidence may be obtained, and how the courts have decided similar cases. This approach allows the client to receive an objective assessment of the prospects before litigation begins.

Remote Legal Services

A significant number of our clients live outside Kharkiv or abroad, while the inherited property is located in Ukraine. We provide a complete remote service: consultations by video call, document exchange through messaging applications or email, and representation before the notary and courts under a notarized power of attorney. In most cases, the client does not need to be physically present in Kharkiv.
