Preparation of Court Documents for Inheritance Cases

Clients frequently contact our law firm requesting the preparation of individual legal documents. Although we generally recommend comprehensive legal representation for inheritance matters rather than preparing individual procedural documents, we understand that many clients throughout Ukraine require professional legal assistance for specific tasks. Therefore, we offer legal services for drafting individual documents that can help you administer an inheritance or resolve an inheritance dispute.

Our inheritance lawyers prepare a wide range of court documents. The most frequently requested services include:

  • preparation of a court application to establish a legal fact;
  • drafting a statement of claim for the recognition of ownership of inherited property;
  • challenging a will through court proceedings;
  • preparing a claim requesting an additional period for accepting an inheritance;
  • preparing a claim for exclusion from the right to inherit;
  • preparing a claim for the judicial division of inherited property;
  • drafting appeals and cassation appeals.

What Is Required to Prepare a Statement of Claim?

1. A well-prepared statement of claim is impossible without strong supporting evidence. Therefore, we ask our clients to provide all available documents for preliminary legal analysis. During this review, we determine whether the available evidence is complete and sufficient, identify any deficiencies or inconsistencies, and assess whether the court will have an adequate evidentiary basis to issue a favorable judgment. If additional evidence is required, we either assist in obtaining it ourselves or provide detailed instructions explaining how it can be collected.

When preparing documents in inheritance matters, our lawyers regularly use attorney requests to obtain evidence efficiently. Under Ukrainian law, responses to attorney requests are generally provided within five business days, and failure to respond may result in administrative liability. This legal instrument allows inheritance lawyers to obtain important evidence more quickly and effectively.

2. We prepare the statement of claim and provide it to the client for review and approval. This stage helps eliminate factual inaccuracies before the claim is filed with the court.

If requested, we will also file the completed statement of claim and supporting evidence directly with the court, making the litigation process significantly easier for our clients. We also recommend our comprehensive legal representation service, under which we manage the entire court case from beginning to end. This approach maximizes the likelihood of a successful outcome while relieving the client of the burden of handling court proceedings.

As a general rule, we recommend filing court claims electronically through the Ukrainian Electronic Court system. However, each case requires an individual assessment. For example, where the case file is extensive or document quality is poor, filing paper copies may be more appropriate. In practice, some courts experience technical or financial limitations that prevent them from printing electronically submitted documents for inclusion in the official paper case file.

Preparation of an Appeal

If the court issues an unfavorable judgment, a professionally prepared appeal is essential. Our inheritance lawyers carefully analyze the judgment and the entire case file, assess the prospects of a successful appeal, and prepare a comprehensive appellate submission.

We will also explain the answer to the question, “How much does it cost to prepare an appeal?” The cost depends on the complexity of the case, the amount of evidence, the size of the case file, and the amount of legal work required to prepare the appeal.

During the preparation of an appeal, additional evidence or documents may need to be obtained. Our lawyers will take all necessary legal steps to secure such evidence or information to maximize the quality of the appeal and improve the client's chances of obtaining a favorable result.

Preparation of a Cassation Appeal

Preparing a cassation appeal is one of the most technically demanding legal services. In addition to drafting persuasive legal arguments, the lawyer must demonstrate to the Supreme Court that the cassation appeal satisfies the procedural requirements for review. In other words, the appeal must successfully overcome the procedural admissibility filters established by law.

The Supreme Court is generally the third and final judicial instance in inheritance disputes. Its decisions usually conclude the litigation, making careful preparation of every procedural document critically important.

Preparing a cassation appeal usually requires a detailed review of a substantial volume of documents and legal materials because the case has already been considered by both the trial court and the appellate court.

The cost of preparing a cassation appeal depends on the amount of evidence involved and the overall complexity of the case. Every lawyer establishes their own fee policy, and we offer flexible pricing tailored to the specific circumstances of each inheritance matter.
