Court Declaration of Death for a Missing Military Service Member in Ukraine

Russia's full-scale invasion of Ukraine has caused countless tragedies for the families of Ukrainian service members. Ukrainian legislation does not provide an administrative procedure for establishing a causal connection between the death of a military service member and combat operations resulting from the Russian Federation's aggression against Ukraine. Therefore, only a court has the authority to legally declare a missing military service member deceased. Such a court decision enables the family to apply for a survivor's pension, obtain the state's one-time compensation payment, receive other social benefits and entitlements, and administer the inheritance.

To file an application with the court, it is necessary to prepare a well-documented package of evidence confirming the circumstances of the disappearance, including:

Documents confirming the family relationship (birth certificate, marriage certificate, etc.).
Official notification from the Territorial Center for Recruitment and Social Support or directly from the military unit confirming that the service member has been recognized as missing in action.
Materials from the official service investigation conducted following the disappearance of the service member.
An extract from the Unified Register of Pre-Trial Investigations (URPI) confirming that criminal proceedings have been initiated regarding the disappearance.
An extract from the Unified Register of Persons Missing Under Special Circumstances.
A certificate issued by the commander of the military unit confirming the missing service member's participation in combat operations or other activities related to the defense of Ukraine.
Witness statements that may form part of the official service investigation.
The order appointing the service member to his or her military position.

This list is not exhaustive. The required documents depend on the specific circumstances of each case and are based on established court practice. Additional documents may be required in individual cases.

According to the updated legal position of the Supreme Court of Ukraine, a missing military service member may be declared deceased only after at least six months have passed following the end of active hostilities in the area where the presumed death may have occurred (Supreme Court Judgment dated December 11, 2024). In determining whether active hostilities have ceased, courts rely on Order No. 376 of the Ministry for Communities and Territories Development of Ukraine dated February 28, 2025. However, the information contained in that order does not always accurately reflect the actual situation on the ground.

The court evaluates all submitted evidence and determines whether sufficient legal grounds exist to declare the missing military service member deceased. If the application is granted, the court decision has full legal effect and allows the family to:

register the death with the civil registry authorities;
apply for a survivor's pension;
receive the state's one-time compensation payment;
exercise inheritance rights;
terminate joint ownership, marital status, and other legal relationships with the deceased.
