Tax planning in inheritance sales often depends on the valuation procedure and the number of real estate transactions completed during the same calendar year.

When is the sale of inherited property exempt from Personal Income Tax?

Ukrainian law provides certain tax exemptions. However, determining whether tax must be paid on the sale of inherited property requires careful analysis of the applicable legal and tax regulations. An individual may qualify for preferential tax treatment if only one residential property is sold during a calendar year. In such circumstances, the seller is exempt from paying the 5% Personal Income Tax and is required to pay only the 1.5% Military Levy.

  • obtain the title documents confirming ownership, including the Certificate of Inheritance;
  • obtain an official property valuation to determine the minimum taxable value;
  • pay the applicable taxes or provide documents confirming eligibility for a tax exemption;
  • execute a notarized sale and purchase agreement.
